1. Service provider
Services are provided under the Yahor Digital brand by SetRa-el KAMIL CIEŚLA, ul. Wronia 25, 98-355 Działoszyn, Poland. NIP: 5080071038 · REGON: 386549675.
2. Proposal and project start
An enquiry, estimate or website price does not create a payment obligation. The project starts after the client approves the written scope, schedule and payment plan and the required first payment is received. Starting prices shown on the website are net reference prices; the final price depends on scope, integrations, content, languages and deadline.
3. Scope and client responsibilities
The approved scope defines the deliverables. The client supplies accurate content, access, brand materials and decisions required for delivery and confirms that supplied materials may legally be used. Delays in feedback or materials may move the delivery date.
4. Payments and invoices
Invoices are issued by SetRa-el KAMIL CIEŚLA in the agreed currency and paid by bank transfer to the account shown on the invoice. Standard website projects use a 50/50 schedule. Larger products normally use milestone payments. Exact amounts, dates, taxes and currency are confirmed in writing before work begins.
5. Reviews and scope changes
Each milestone includes a reasonable review round as stated in the proposal. Corrections that bring the work into the approved scope are included. New functionality, a changed direction, extra language versions or work requested after approval may require a separate estimate and schedule adjustment. No extra paid work is started without written approval.
6. Acceptance and launch
The client receives a reviewable version and a reasonable period to report issues against the approved scope. A milestone is accepted when it is approved in writing, published at the client’s request or used in production. Hidden technical defects reported during an agreed warranty period are corrected without additional charge.
7. Intellectual property
After all invoices for the project are paid, the client receives the rights or licence described in the proposal for the agreed deliverables. Pre-existing tools, open-source components, fonts, stock assets and third-party services remain subject to their own licences. Unpaid concepts and source files remain with the service provider.
8. Third-party services
Hosting, domains, app stores, payment providers, APIs and other external services may have separate fees and terms. Unless the proposal says otherwise, the client owns and pays for those accounts. Yahor Digital is not responsible for an external provider’s outage, rejection, policy change or price change, but will provide reasonable implementation support.
9. Cancellation and suspension
Either party may end a project under the rules in the signed proposal or agreement. Completed work and committed costs remain payable. Work may be paused when an invoice is overdue or essential client input is missing. Any unused portion of a prepayment is handled according to completed work and contractual commitments.
10. Consumer right of withdrawal
Where mandatory consumer law applies to a distance service contract, a consumer may have 14 days to withdraw without giving a reason. If the consumer expressly requests work to begin during that period, payment may be due for services proportionally performed before withdrawal. The right may be lost after the service has been fully performed where the legally required prior consent and acknowledgement were provided. Exact information and any required withdrawal form will be supplied with the individual agreement.
11. Confidentiality and portfolio use
Non-public project information is treated as confidential. Unless otherwise agreed in writing, Yahor Digital may identify the client and show the publicly launched result in its portfolio after publication. Confidential or white-label work can be agreed before the project starts.
12. Liability and governing terms
Each party remains responsible for its own obligations. Detailed warranties, liability limits, applicable law and dispute rules are defined in the signed agreement. Nothing on this page limits rights that cannot legally be excluded.
